In a recent article entitled Canadian anti-spam law penalties, agency track records increase focus on compliance by July 1, 2014 in-force date, authors Theodore Ling, Arlan Gates and Lisa M. Douglas of Baker & McKenzie notes that that the new Canadian Anti-spam Law (CASL) is one of the toughest anti-spam laws in the world. This largely due to the severity of fines and penalties that could be as high as $10,000,000. Given the magnitude of the fines and a provision that can result in directors and or officers of organizations being held personally liable many directors, officers and business owners are asking “is this covered under our business insurance ?”
