Insurance Requirements For Ships That Carry Passengers In Canada
Transport Canada regulates marine transportation in Canada as marine safety for all Canadians is a priority. In an attempt to ensure ship operators who are engaged in the carriage of passengers have sufficient insurance to cover the potential liability resulting from their operations, the insurance requirements for ships that carry passengers in Canada were changed (see Insurance Requirements For Ships). Effective January 11, 2019 the regulations for insurance requirements for ships that carry passengers in Canada changed and now require all commercial and public purpose ships that are engaged in the domestic carriage of passengers in Canada to maintain liability insurance coverage in a minimum amount of $250,000 multiplied by the passenger capacity of the ship.

The change to insurance requirements for ships that carry passengers in Canada is driven by part 4 of the Marine Liability Act which makes ship owners liable for the death or injury of their passengers. This change applies to any and all commercial or public purpose ships in Canada that carry passengers from one place back to that same place or to another place.
However, theses regulations don’t apply to:
- adventure tourism, as defined in subsection 37.1(1) of the Marine Liability Act
- the carriage of a sail trainee
- an international carriage
- a carriage by pleasure craft, as defined in section 2 of the Canada Shipping Act, 2001
- search and rescue operations carried out by the Canadian Coast Guard Auxiliary
- the Government of Canada or the government of a province (because they are self-insured),
or an entity entitled to indemnification by that government
